Trina pulls Sec. 337 investigative complaint against Canadian Solar

Trina Solar has requested updates to its Sec. 337 of the Tariff Act investigation against several competitors manufacturing TOPCon solar panel products. Trina requested that the U.S. International Trade Commission (ITC) complete its investigation by October 2024, which would direct U.S. Customs to prevent infringing imports from entering the United States, against the import of TOPCon solar energy from Runergy, Adani Green Energy and Canadian Solar.

Before late last year, Trina said in documents filed with the ITC that she had reached an agreement with Canadian Solar and its subsidiaries and wanted to withdraw the complaint and end the investigation. In addition, Trina said she had met with Adani and wants to withdraw her complaint against the Indian company, and instead add Mundra Solar PV (a subsidiary of Adani) as the company under investigation. Trina plans to continue the complaint against Runergy and now Mundra.

This sec. 337 investigation request arises from TOPCon patent infringement claims filed by Trina against the companies. Trina claims that Runergy and Canadian Solar infringe two of Trina’s patents (Nos. 9,722,104 and 10,230,009). While a Sec. The investigation is still ongoing, the patent infringement cases have been suspended.
