Solar cells are not exempt from American rates despite media reports

Solar cells are not exempt from the recent American mutual import tariffs, and recent reports by large media seem to be a wrong interpretation of government documentation.

Rates Are back in the news, but they are not exactly a new topic for the solar industry.

At the end of last week, the performing power of the US government has one executive order A subset of electronic articles of mutual import tariffs that are currently against China.

Although several important media stores report that solar cells are being recorded and exempt, none of these codes are included in the list of executive order.

The executive order stated various harmonized tariff schedule of the codes of the United States (HTSUs), some of which are shown below, which are now exempt from the extra tasks:

  • 85411000
  • 85412100
  • 85412900
  • 85413000
  • 85414910
  • 85414970
  • 85414980
  • 85414995
  • 85415100
  • 85415900
  • 85419000

These HTSUS codes are followed in the HTSUS database, which is published by the US International Trade Commission (USITC). Most exempt hardware items are subdivided under Chapter 85which broadly relates to “electrical machines and equipment and parts thereof.”

The confusion probably starts with the fact that most of these items are classified under subsection 41 within Chapter 85, which is described as:

“Semiconductor devices (for example diodes, transistors, based transducers-based transducers); light-sensitive semiconductor devices, including photovoltaic cells, whether or not assembled in modules or invented in panels; light emitting diodes (LED); (LED);

The subsection description clearly states that photovoltaic cells, either in solar panels or not, are included in this section. The codes within that subsection that specifically refer to solar cells are 8541.42.00 (solar cells, assembled in modules or panels) and 8541.43.00 (solar cells, not assembled in modules or panels).
