The European Council has approved a law that postpones the implementation of Due Diligence obligations until 18 August 2027 to give battery producers and exporters more time to prepare for their approval.

In October 2024, the European Council urged all EU institutions, member states and stakeholders to give priority to tackling the challenges identified in the “much more than a market” report from Enrico Letta and the “The Future of European Competitiveness” study by Mario Draughi. As a result, the legislative package of Omnibus IV was adopted as part of an EU effort to support industrial competitiveness and to reduce the complexity of the regulations.

Such a bureaucratic measure is regulation 2023/1542 on batteries, for which battery producers needed to set a due diligence policy and have verified and subject batteries to regular audits by third parties.

Battery companies will have to report on due diligence practices, including waste management, to reduce the impact of the environment and other obligations with regard to the supply, processing and trade of cobalt, natural graphite, lithium and nickel will be used in their products.
