Longi sues Jinkosolar for alleged infringement of the patent in China, the United States

Longi has brought the lawsuit in China at the Jinan Intermediate People’s Court in Shandong and immediately demanded a cessation of production, sales and offers to sell the alleged infringing products. The lawsuit in the United States was brought to the court for the Eastern district of Texas.

The Chinese solar module manufacturer Longi has brought two lawsuits of patent infringement on Jinkosolar and claims the use of his solar cell technology in China and the United States.

In China, Longi brought the lawsuit to the Jinan Intermediate People’s Court in Shandong and demanded an immediate stopping of production, sales and offers to sell the alleged infringing products.

“The Jinan Intermediate People’s Court has accepted the case, with an expected test date that was established before March 20,” the company said in a statement.

In the United States, the lawsuit was brought against Jinko Solar and its subsidiaries at the US district court for the eastern district of Texas, with a patent infringement at the topcon of Jinko Solar and several other non -specific photovoltaic module products.

Jinkosolar recently took similar actions against Longi in China, Japan and Australia.

In December 2024, Jinkosolar also brought a lawsuit in the violation against competitor Vsun, a unit of the Japanese Fuji Solar, in the American district court for the Northern district of California. Jinkosolar said the VSUN and his American affiliated companies have sued it, but did not identify a specific patent.

Last week Jinkosolar complained the Indian Sun company where Energies and its American subsidiary, where Solar Americas, in the American court for the southern district of Texas, with an infringement of his N-Type Topcon Patent, US11.824.136B2.

Since the beginning of 2024, competition in the Chinese solar industry has shifted from price fights to a fully-fledged patent war. A series of disputes about intellectual property about Topcon and Back Contact (BC) technologies have broken out, involving important players in the industry such as Trina Solar, Canadian Solar, Longi, Jinkosolar, JA Solar and Astronergy, among others. This case marks the latest development in this current conflict.
